Studio Hire
These terms and conditions are for hiring the Studio(s). By agreeing to work with The Spot 101 Studio and booking the Studio(s), you automatically agree to our terms and conditions.
I. Definitions
In these conditions the following expressions have the following meanings:
“The Spot 101” – and any of the partners or any servant, agent, employee or sub-contractor on behalf of The Spot 101.
“The Customer” / “Booker” / “Client” – any person or firm or company dealing with The Spot 101 or any servant or employee of such a person, firm or company.
“Services” – shall include all Studio space or facilities and the services of drivers and assistants and other personnel of The Spot 101 or of any sub-contractor of the Company.
“Equipment” – shall include all fixtures, lighting and other materials provided by The Spot 101 or by its nominated sub-contractors.
“Studio” – the premises of The Spot 101 for the time being where the services and equipment are provided.
II. General
These Conditions constitute the entire contract and may not be varied otherwise than in writing signed by a duly authorised signatory on behalf of The Spot 101.
Full details of The Spot 101 services and (non-commercial) charge rates are set out on the Studio website. Prices and rates available on these pages and on the website may be varied by The Spot 101 without notice.
The Customer shall inform The Spot 101 whether they require a member of The Spot 101 staff (at extra costs) to be on site to assist with equipment, lighting etc. during the booking.
Nothing in these Conditions is intended to exclude, restrict or modify liability on the part of The Spot 101 resulting from negligence or otherwise.
III. Studio Hire
The Studio may be provisionally booked by telephone or email and the booking should be confirmed (email or telephone) within 24 hours of the provisional booking. The Customer will be required to pay the full amount of the hire fee as confirmation of the booking or the booking will be removed.
The Customer must observe all regulations governing the use of the Studio and of any Equipment and services whether imposed by The Spot 101 or by any statutory body or Local Authority.
The Studio is available for the exclusive use of the Customer named in the booking (and their party). The Customer is not permitted to sub-contract, sub-let or otherwise permit any third party to utilise the Studio without the prior written consent of The Spot 101.
Any materials used in connection with sets constructed by the Customer as well as any rubbish shall be removed from the Studio at the end of the hire period at the expense of the Customer; otherwise The Spot 101 will charge for this.
No alterations, decorations or additions to the Studio are permitted without the consent of The Spot 101, and at the end of the hire period the Studio must be surrendered in the same condition it was in at the start of the hire period. Any costs incurred by The Spot 101 arising out of any breach of this condition shall be paid by the Customer.
The Studio is supplied clean at the start of the hire period and all costs of painting, repairing and maintaining this state are payable by the Customer. The Spot 101 must be notified by the Customer at the start of the hire period if any aspect of the condition or decoration of the Studio is unacceptable. If no such notification is given, the Studio will be determined to be of an acceptable standard for use by the Customer.
The Customer must include set up, take down and clean up time within the hours booked, to avoid overtime charges. Overtime is charged at £30 per hour for each studio used.
Noise levels must be kept to a reasonable level during Studio hire bookings. Clients are asked to consider other occupants and neighbours when using the Studio.
Dogs are allowed in the Studio (£20 dog attending fee applicable). All liability and responsibility of animals will be that of the Client.
No smoking is permitted inside the Studio or throughout the building.
No illegal activities are permitted. Anyone not compliant will be asked to leave and/or police will be called.
Wellington House is fitted with CCTVs. Images are recorded for the purpose of crime prevention and staff safety and may also be stored to claim for any damages incurred during the booking.
Please note that in the case of sound recording, due to our location The Spot 101 cannot guarantee absolute silence on set. If required, please contact us first and we will do our best to accommodate.
IV. Hire of Equipment and Services
All Equipment and services are supplied by The Spot 101 entirely at the risk of the Customer. The Spot 101 shall not be liable for loss or damage of any kind to material, props or equipment entrusted to it however caused, including consequential loss and loss of profit. The Customer is responsible for any loss or damage to the Equipment or the Studio caused by or arising from the Customer’s use thereof.
All Equipment supplied is in good condition. The Customer must notify The Spot 101 at the time of supply if the condition is not acceptable.
The Customer may not, without the written consent of The Spot 101:
Remove the Equipment from the Studio premises or move props on their own.
Modify, alter or tamper with the Equipment.
Use the Equipment in a manner not recommended by the Manufacturer.
Allow the Equipment to be used by untrained or unauthorised personnel.
Part with possession, sell, pledge, encumber or suffer any lien to be created on the Equipment.
Where The Spot 101 supplies the services of a driver, assistant, sub-contractor, freelancer or other personnel at the request of the Customer, such persons shall be deemed to be servants of the Customer. The Spot 101 shall not be liable for loss or damage of any kind however caused.
The hire period for services or Equipment cannot be extended without the consent of The Spot 101.
Equipment must be returned promptly at the end of the hire period in good condition. The Customer shall pay or compensate The Spot 101 for the replacement value (plus any administration fee) of lost or damaged Equipment, or for failure to return the Equipment on time.
Studios must be left clean and in the same condition as found. Excessive mess will result in a £25 cleaning fee billed to the Client.
Add-ons such as backdrops or props are non-refundable if not used.
V. Payment and Additional Charges
Unless otherwise agreed in writing, all transactions will be settled in agreement with The Spot 101’s payment terms before the commencement of the hire period. Clients must settle accounts within 24 hours of booking.
Overdue payments will incur interest at 15% per week or part thereof.
The hire time commences when the agreed hire period starts (with or without the Customer being present) and terminates when the Studio and/or Equipment is surrendered or returned. Overtime charges are set at £30 per hour unless otherwise agreed in advance.
Any additional Equipment, services, staff or modifications to the booking shall be billed to and paid for by the Customer. This includes refreshments and extra rentals.
Any damage will be charged at full replacement price plus 25% administration/restock fee.
Customers must have their own public liability insurance. The Spot 101 cannot be held responsible for injuries or damages to persons or equipment due to client negligence.
VI. Exclusions of Liability
The Spot 101 shall not be liable for any loss, damage, expense, liability or consequential loss (including loss of profit) arising out of:
Any damage to or loss of property by the Customer or their agents.
Any breakdown or failure of facilities or Equipment.
Any death or injury occasioned to the Customer or their agents, unless directly attributable to the negligence of The Spot 101.
Any fines or legal costs connected with the hire of the Studio or Equipment.
Any circumstances beyond the control of The Spot 101.
Anything left at the Studios will be disposed of or given to charity if not claimed within 24 hours.
VII. Indemnity
The Customer shall indemnify The Spot 101 against all actions, claims, costs, charges and expenses made by any third party in respect of any alleged injury, loss, damage or expense arising out of the use of the Studio or Equipment, even where caused in part by The Spot 101.
The Customer must ensure they have their own public liability insurance for all persons in the Studio during the hire.
VIII. Minors
All minors under the age of 16 must be accompanied by a chaperone. Parent or guardian permission is required for minors to be at the Studio and to be photographed or filmed.
IX. Booking Reschedule, Cancellations & Refunds
Midi, Ibiza, Savannah, and Victorian Rooms:
Cancellations or reschedules may be made with at least three (3) days’ notice (72 hours prior to booking start time) without charge. Cancellations or changes made within three (3) days will incur a fee or forfeiture of the deposit.
Skylight and Blackout Rooms:
Cancellations or reschedules may be made with at least five (5) days’ notice (120 hours prior to booking start time) without charge. Cancellations or changes made within five (5) days will incur a fee or forfeiture of the deposit.
Rescheduling Limit:
Bookings may only be rescheduled once, provided the request complies with the notice periods above. Further changes require a new booking.
Rescheduling Process:
Bookings may be rescheduled online via the confirmation email, if within the permitted notice period. Requests outside this period must be made directly to The Spot 101 and will incur fees.
Refunds:
Deposits are non-refundable if cancellations are made within the required notice period (3 or 5 days, depending on the Studio). Refunds will only be issued where cancellations are made in line with the notice requirements above.
X. Termination
The Spot 101 may terminate any hire contract if:
The Customer fails to pay monies due.
The Customer enters liquidation, bankruptcy or receivership.
The Customer breaches these terms and conditions.
Termination shall be without prejudice to rights accrued to The Spot 101 prior to termination.
XI. Applicable Law
These Conditions shall be governed by the laws of England, Scotland, Wales and Northern Ireland.
